The purpose of these general conditions of sale is to govern the contractual relations between L'Odyssée Paris, (Company name: Leila Christelle TOCNY - Commercial name: L'Odyssée Paris registered with RCS n° 582064026, Siret 817 699 622 00012) whose head office is located 

45 rue de Maubeuge 75009 Paris, FRANCE

intra-community VAT number FR 15817699622, and the user of the lodyssee-paris.com site defined below as the Customer

 

GENERAL CONDITIONS OF SALE (CGV)

 

Any online purchase made on the website www.lodyssee-paris.com is subject to prior knowledge and acceptance of these general conditions of sale.

 

 

1 - DEFINITIONS

Article: Products of any kind offered for sale (e-commerce service) on the Site

Customer: non-commercial natural person carrying out the Order, and holding full legal capacity.

Order: commitment to purchase all the Items selected by the Customer via the Site's e-commerce service.

Site: website published by L'Odyssée Paris and accessible at the address  www.lodyssee-paris.com

 

 

2 - PREAMBLE

These general conditions of sale (hereinafter "GTC") apply exclusively between any Customer and the company L'Odyssée Paris, whose head office is located at 45 rue de Maubeuge 75009 Paris, registered in the Trade and Sociétés de Paris under number 582064026 (hereinafter “L’Odyssée Paris”).

The T&Cs are applicable without restriction or reservation to all the Items offered for sale on the Site.

Any Order on the Site is subject to prior consultation and unreserved acceptance by the Customer of these T&Cs and the applicable prices.

The Customer's "click" on the "I accept" button accessible on the page dedicated to the validation of the order constitutes acceptance.

These T&Cs prevail over any other document. We invite you to read them carefully.

 

 

3 - WARNING

The sale of Items on the Site is exclusively reserved for retail and private individuals.

Under no circumstances may the Site be used by professional sellers, alone or in groups, regardless of the method of marketing their products (marketplaces on the internet, shopping malls, intermediaries, physical stores in particular). The Customer therefore acknowledges and accepts that the Articles can only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Articles ordered in a single order and the number of individual Orders respecting the usual amount an average consumer spent for the same product. L'Odyssée Paris reserves the right to refuse an order clearly validated by a professional seller Customer.

Any Customer declares to be informed of the lack of reliability of the Internet network, especially in terms of relative security in the transmission of data, non-guaranteed continuity in access to the Site, non-guaranteed performance in terms of volume and speed of transmission data and the spread of viruses.

L'Odyssée Paris warns each Customer of the need to implement within their computer or portable or mobile equipment a security solution and measures to prevent the spread of viruses.

 

 

4 - APPLICATION OF THE GENERAL CONDITIONS OF SALE

These General Terms and Conditions of Sale are intended to define the contractual relationship between the Seller and the Customer, and the conditions applicable to any purchase made through the Seller's merchant site https://www.lodyssee-paris.com, below referred to as "the Site".

By these General Conditions of Sale, the Customer is prohibited from any purchase for resale, within the meaning of Article L 110-1 of the Commercial Code.

The Customer must be at least 18 (eighteen) years old and have the legal capacity or hold parental authorization allowing him to place an order on the Site.

The acquisition of a product through the Site implies full acceptance by the Customer of these General Conditions of Sale.

These will prevail over any other general or specific conditions of the Customer.

The Seller reserves the right to modify these General Conditions of Sale at any time. It is however agreed that the Conditions applicable to the Customer will be those in force on the date of his order on the Site.

These General Conditions of Sale are the exclusive property of the Seller. Any reproduction, even partial, is strictly prohibited.

 

 

5 - ACCESSIBILITY

www.lodyssee-paris.com is an e-commerce site owned and operated by L'Odyssée Paris.

The Site is accessible to all users of the Internet network in principle 24 hours a day, 7 days a week, except for interruption, scheduled or not, by L'Odyssée Paris or its service providers, for the purposes of its maintenance and/or security or force majeure (as defined below). L'Odyssée Paris cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.

L'Odyssée Paris does not guarantee that the Site will be free from anomalies, errors or bugs, or that the Site will operate without failure or interruption. In this regard, he may freely and at his entire discretion determine any period of unavailability of the Site or its content. L'Odyssée Paris cannot be held responsible for problems with data transmission, connection or unavailability of the network.

L'Odyssée Paris reserves the right to change the Site, for technical or commercial reasons. When these modifications do not substantially and negatively alter the conditions of the provision of services, the Client may be informed of the modifications made, but his acceptance is not requested.

 

 

6 - ORDER

6-1 Order process

To be able to place an order, the customer must first register on the site by creating an account.

When creating his account, the customer must ensure the accuracy and completeness of the data he provides. The customer is required to update his personal information.

In the event of an error in the wording of the recipient's contact details, Odyssée Paris cannot be held responsible for the impossibility of delivering the products.

The Customer wishing to place an order on the Seller's Site https://www.lodyssee-paris.com must:

• Fill in the following information on the Site, namely: surname, first name, postal address, e-mail address, telephone number.

• Consult the products and add them to your basket

• Validate the basket

• Validate the order

Choose and validate your payment method.

If you already have an account in our e-boutique, identify yourself using your e-mail address and password in the "Already registered?" ".

If you do not yet have an account in our e-shop, you can create one easily and quickly: in the section "Not yet registered?" . Fill in the detailed fields: Name, First name, E-mail address, Password. Confirm the creation of your account by clicking on the "Create your account" button.

An e-mail will then be automatically sent to you, reminding you of the information necessary for your next connection (e-mail address and password).

The Seller will communicate to the Customer by e-mail the confirmation of the registered order.

All the data provided and the recorded confirmation constitute proof of the transaction and acceptance by the customer of the GCS, the products purchased, their price and the associated costs.

The Seller will archive Orders and Order confirmations on a reliable and durable medium constituting a faithful copy, in accordance with the legal provisions in force.

The Seller's computerized registers will be considered by the Parties as proof of communications, orders, payments and transactions between the Parties.

The banking transaction is secure and in no way does the Seller keep any banking information relating to the Customer.

Finally, it is specified that the Seller reserves the right to refuse an Order presenting an abnormal nature, in particular with regard to the quantities ordered.

L'Odyssée Paris may delete the customer's account at any time, for any reason, at its sole discretion.

 

6-2 Promotional codes (discounts)

A promotional code entitles you to a one-time discount for the purchase of one or more products under the conditions provided for on the promotional code.

Promotional codes are personal. Promotional codes are inalienable and may not be sold, bartered, exchanged, or made available to the public free of charge or for a fee on a website or any other communication medium without the prior, express and written authorization of L'Odyssée. Paris.

The promotional codes published by L'Odyssée Paris can only be used on the www.lodyssee-paris.com website.

You can only use one promotional code per product.

Promotional codes cannot be combined with other promotions.

Promotional codes are not redeemable for cash.

Promotional codes are non-refundable.

L'Odyssée Paris reserves the right to cancel a promotional code when it is not used in accordance with the above.

 

6-3 Pre-ordering an item

Pre-ordering allows you to reserve a product before it is marketed by L'Odyssée Paris and to be among the first to benefit from a new L'Odyssée Paris product. 

The pre-order will be available later on L'Odyssée Paris.

 

 

7 - DESCRIPTION OF PRODUCTS

The products offered for sale are presented on the Seller's Site https://www.lodyssee-paris.com within the limits of available stocks.

In this regard, L'Odyssée Paris cannot be held responsible for the cancellation of an order due to the depletion of stocks.

The photographs relating to the presentation of the products cannot ensure a perfect similarity with the products offered and present, in certain cases, presentation suggestions not offered for sale.

However, it is possible that errors may appear in the presentation, description of the products and on the site, which the customer acknowledges and accepts.

It is specified that the products offered comply with the regulations in force relating to the composition of the products, in the sense that they comply with the rules in force.

 

 

8 - PRICE AND TERMS OF PAYMENT

Customs fees and other taxes are not included in the price paid by the customer.

These costs must be paid by the customer directly to the carrier.

The prices indicated by the Seller at the time of the Order are denominated in Euros (€), Net to be paid. 

The Seller reserves the right to modify its prices at any time, it being understood, however, that the prices presented on the Seller's site on the day of the Order will only be applicable to the Customer.

The transport and delivery costs applied are those indicated on the Site at the time of the Order.

The sale price is payable upon placing the Order.

The products are payable in cash when the actual Order is placed.

The Order can be paid by the following means:

HiPay SAS, is a simplified joint-stock company, whose registered office is located at 6 Place du Colonel Bourgoin, 75012 Paris, registered with the Paris RCS under number 390 334 225. Contact e-mail address: contact@hipay.com

This solution which presents highly secure pages for entering payment data: card number, expiry date and visual cryptogram.

This platform encrypts then transmits this payment data to the bank, in complete confidentiality and makes it inaccessible to a third party.

The Customer's bank card number is sent to the secure servers of our partner HiPay (3D Secure) or to the secure Paypal page.

The customer expressly acknowledges that the communication of his credit card number to Odyssée Paris constitutes authorization to debit his account up to the price of the products ordered. If necessary, a notification of Order cancellation for non-payment is sent to the customer by Odyssée Paris to the address provided by the customer.

The Seller's computerized records will be considered by the Parties as proof of communications, Orders, payments and transactions between the Parties.

The banking transaction is secure and, in no way, the Seller does not keep any banking information relating to the Customer. A net invoice to be paid in euros (€) will be sent by the Seller to the Customer.

 

 

9 - DELIVERY

L'Odyssée Paris offers delivery as follows:

Colissimo  at home  and at a pick-up point

- Standard delivery in France (Corsica and Monaco included) with Colissimo. The average delivery time is 3 to 5 working days after shipment. 

 

- Standard delivery in Europe (see Delivery Charges by Zone below 9-1) 

The average time is 6 to 8 working days after shipment. 

 

Standard International delivery (see Delivery costs by Zones below 9-1) the average time is 6 to 11 working days after dispatch.

 

Mondial Relay delivery

- Standard delivery in France (Corsica and Monaco included) with Colissimo. The average delivery time is 3 to 6 working days after shipment. 

 

- Standard delivery in Europe (see Delivery Charges by Zone below 9-1) 

The average time is 6 to 8 working days after shipment. 

 

Standard International delivery (see Delivery costs by Zones below 9-1) the average time is 6 to 11 working days after dispatch.

 

L'Odyssée Paris delivers Orders within a maximum period of 12 (twelve) working days for Delivery in France and 20 (twenty) working days for European and International Delivery. This period is counted from the day after the validation of the Order. 

Under no circumstances may the delivery time exceed 30 (thirty) days. If the delivery deadline is exceeded by more than 7 (seven) days and not due to a case of force majeure (below) in relation to the maximum period referred to above, the Customer may contact L'Odyssée Paris Customer Service for enjoin him to carry out the delivery within a reasonable additional time. In the event of non-compliance with this new deadline, the Customer may request from Odyssée Paris by e-mail the reimbursement of his Order. The contract and therefore the Sale will be considered terminated upon receipt by L'Odyssée Paris of the e-mail or letter by which the Customer informs it of its decision, unless delivery has taken place between sending and receiving the Customer's e-mail or letter.

In the event that the Order is definitively cancelled, the Customer will obtain a refund of the Price paid for his Order within 30 (thirty) days following the cancellation confirmed by e-mail.

Reimbursement will be provided by the Seller, according to the means of payment used during the initial Order.

Additionally, we reserve the right not to deliver an order if we believe the address is unsafe. For example in the case of a collective postal address, or a post office box. If this affects any of your orders, we will let you know as soon as possible.
In order for these deadlines to be respected, the Customer must ensure that he has communicated exact and complete information concerning the Delivery address (such as, among other things: street number, building, staircase, building codes, access, names and/or intercom numbers, etc.).

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, of a natural person of his choice or of a legal person (delivery to his company ). 

Delivery cannot be made to hotels or to post office boxes.

If it is impossible to make the Delivery, due to an incorrect delivery address, no reshipment can be made and the Customer will be reimbursed within 5 (five) days of receipt of the Order by the Odyssey Paris.


Notwithstanding the foregoing, L'Odyssée Paris cannot be held responsible for the harmful consequences resulting from a delay in delivery, only reimbursement of the Product by L'Odyssée Paris being possible to the exclusion of any other form of compensation.


When L'Odyssée Paris takes care of the delivery of the Product, the risk of loss or deterioration of the Product is transferred to the Customer at the time of Delivery.

As an exception, the risk is transferred to the Customer when the Product is handed over to the carrier when the latter is responsible for transport by the Customer and not by L'Odyssée Paris.

L'Odyssée Paris cannot be held responsible for delays in delivery that are not its fault or justified by a case of force majeure:

 


Force Majeure 

In the event of the occurrence of an event of force majeure preventing the execution of these GCS, L'Odyssée Paris shall inform the Customer thereof within 15 (fifteen) days of the occurrence of this event, by email or by letter. registered with acknowledgment of receipt. 

Expressly, are considered as cases of force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of French courts and tribunals, total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or disputes business, civil disturbance, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal modifications or regulatory forms of marketing, computer failure, blocking of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship. All of the parties' obligations are suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than 3 (three) months, the transaction concerned may be terminated at the request of L'Odyssée Paris or the Client without compensation on either side. Failure to pay by the Customer cannot be justified by a case of force majeure.

The shipment is made by the services of La Poste in Colissimo. Shipping costs are €8.

2.2 - ZONE 3  (Sweden, Switzerland, Denmark, Hungary, Poland, Czech Republic, Slovakia, Slovenia, Estonia, Latvia, Lithuania)  - ZONE 4 ( Specific territories of Spain, Bulgaria, Cyprus, Croatia, Finland, Greece, Iceland, Malta, Norway, Romania).

The shipment is made by the services of La Poste in Colissimo. Shipping costs are €9.90.

 

3-INTERNATIONAL ZONE 5  (USA, Canada, Japan, Russia):

The shipment is made by the services of La Poste in Colissimo. Shipping costs are €30 excluding customs fees and taxes.

 

 

10 - RETURNS & REFUNDS

Without prejudice to the provisions relating to returns or the right of withdrawal mentioned below (paragraph 15), L'Odyssée Paris offers the Customer the possibility of returning the Items ordered on its website.

To be accepted, this refund must be made in strict compliance with the following terms:

 

The Customer must return his item within a maximum period of 30 (thirty) calendar days from receipt of your Order (no returns will be accepted if the Item has been worn and/or washed). Any claim made beyond the 30 (thirty) day period indicated above cannot be accepted and L'Odyssée Paris will be released from all liability.

Return costs are the responsibility of the Customer.

The refund will be made provided that L'Odyssée Paris has received the products initially delivered in perfect condition for resale, in its original packaging, in its original condition, new, labeled, unworn, unwashed.

Returns will only be made after first contacting the “L'Odyssée Paris” Seller via the return form.

Subject to the perfect condition of the returned product, the refund will be provided by the Seller, using the same means of payment as that which will have been used for the payment of the order, within a maximum period of 30 (thirty) days.

L'Odyssée Paris reserves the right to refuse the return of products that do not comply with the conditions mentioned in these general conditions. In this case, the goods are returned to the customer.

 

For any request for return (refund), the Customer must first complete the form available:

As soon as the return is accepted by L'Odyssée Paris, the Customer will be informed by e-mail and may return the package.

To make a return: 

1. The Customer must complete and sign the Return Form.

2. The Customer must insert this Return slip in his package as well as the Product(s) to be returned.

3. The Customer must enter the following postal address:

Return costs are the responsibility of the Customer. 

It is the Customer's responsibility to keep all proof of this return and its date.

Only new, unworn and unsoiled products will be refunded. The Item must be returned in its original packaging accompanied by the label of the garment, its pouch and/or Dust Bag.

 

The return will be refused and will not give rise to reimbursement, in the following cases:

1 - Return of the order without its fabric pockets, without the accessories provided, without its box and/or without Dust bag and/or without sealed or cut label.

2 - The products have been washed, used or worn except for a simple fitting

3 - The product is not complete. If your order includes different products that are not linked together (non-exhaustive examples of products linked together: pair, inseparable set, etc.), you can return only part of your order. Only returned products will be refunded

4 - The products have been modified or denatured

Once the verification of the returned items has been carried out, L'Odyssée Paris undertakes to reimburse the Customer as soon as possible 4 (four) to 5 (five) calendar days, within a maximum period of 30 (thirty) days following the date of validation of the return, to the Customer's bank account or payment account used for payment of the Items.

 

11 - UNAVAILABILITY OF PRODUCTS

L'Odyssée Paris cannot be held responsible for the cancellation of an order due to the exhaustion of stocks. In case of unavailability of the product ordered in stock, the Seller will inform the Customer by e-mail, as soon as possible and the price will be refunded to the Customer, within 30 (thirty) days of payment of the sums he has paid.

The Customer will then have the possibility of obtaining a refund (within 30 (thirty) days of payment of the sums he has paid).

 

 

12 - RESPONSIBILITY

The Seller may exonerate itself from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the Customer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure.

The Seller cannot be held responsible in the event of a computer problem occurring during his order, related to the Customer's internet connection.

 

The liability of L'Odyssée Paris with regard to any Product purchased on the Site is strictly limited to the purchase price of the latter. L'Odyssée Paris shall in no event be liable for the following losses, regardless of their origin: loss of income or sales / operating loss / loss of profits or contracts / loss of planned savings / loss of data / loss of working or management time / damage to image / loss of opportunity, and in particular ordering a Product / moral damage.

 

The documents, descriptions and information relating to the Products appearing on the Site are not covered by any guarantee, explicit or implicit, with the exception of the guarantees provided for by law.

 

L'Odyssée Paris does not provide any guarantee concerning any damage which could be caused by the transmission of a computer virus, a worm, a time bomb, a Trojan horse, a cancelbot, a logic bomb or any other form of programming routine designed to damage, destroy or otherwise impair the functionality of a computer or to interfere with the proper functioning of it, including any transmission resulting from a download of any content made by the Customer, of the software used by the latter to download the content, of the Site or of the server which allows access to it. In this regard, the Customer acknowledges that it is his responsibility to install appropriate anti-virus and security software on his computer hardware and any other device in order to protect them against any bug, virus or other programming routine of this order proving harmful.

 

The Customer acknowledges assuming all risks related to any content downloaded or obtained in any other way through the use of the Site and agrees that he is solely responsible for any damage caused to his computer system or any loss of data resulting from the downloading of this content.

 

L'Odyssée Paris is only required to deliver Products that comply with the contractual provisions. The Products are considered to comply with the contractual provisions if the following conditions are met: 

They must comply with the description and have the characteristics displayed on the Site; 

They must be suitable for the purposes for which products of this type are generally designed ; 

They must meet the quality and resistance criteria which are generally accepted for products of the same type and which can reasonably be expected.

 

In addition, L'Odyssée Paris guarantees consumers against lack of conformity and hidden defects for the Products for sale on the Site under the following conditions:

 

Visible defect

The presence of an apparent defect on a Product must give rise to a complaint by e-mail (bienvenue@lodyssee-paris.com) within three working days following Delivery. Any complaint must explain the defect concerned. Otherwise, no complaint is admissible, and no return or exchange is possible. The Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, labeled with the references of the initial Order and a copy of the complaint to the head office of L'Odyssée Paris, after the sending of an e-mail indicating the apparent defect of the Product referred to above. The cases of apparent defect confirmed by L'Odyssée Paris give rise, depending on the content of the Customer's complaint, either to the establishment of a credit note for the benefit of the Customer, or to the replacement of the Product, or to the outright refund of the Price to the Customer within 14 (fourteen) days. In case of non-compliance with the return procedure, no refund, no exchange or credit is possible.

 

Non-compliance – Hidden defects

Subject to the validation of a non-conformity or a hidden defect by L'Odyssée Paris or the manufacturer as the case may be, the Customer benefits from the following guarantees:

 

L'Odyssée Paris, whose registered office is located at 45 rue de Maubeuge - 75009 Paris, France, acts as guarantor within the meaning of the provisions of articles L 217-5 and following of the Consumer Code and 1641 and following of the Civil Code.

 

Thus the Customer:

- benefits from a period of two (2) years from the delivery of the Product to act in default of conformity of the Product,

- is exempted from providing proof of the existence of the lack of conformity of the goods during the six (6) months following the delivery of the Product,

- can choose between repairing or replacing the Product, subject to the cost conditions provided for in article L217-9 of the consumer code;

 

The legal guarantee of conformity applies independently of the commercial guarantee described below.

 

In addition, the Customer can also implement the legal guarantee for hidden defects of the thing sold, within the meaning of articles 1641 and following of the Civil Code. The legal guarantee against hidden defects allows the Customer, within two years from the discovery of the defect, to reimburse a Product which has proved unsuitable for its use. 

 

The warranty against hidden defects allows the Customer to be protected against hidden defects of the Product purchased and which prevent its use or affect it to such an extent that the Customer would not have purchased it.

 

The Customer then has the choice between two options: keep the Product and request a price reduction, or return the Product and request reimbursement of the price paid, in accordance with article 1644 of the Civil Code.

 

In order to implement these guarantees, the Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, labeled with the references of the initial Order and a copy of the complaint to the head office of L'Odyssée Paris, after sending an e-mail indicating the reason for the return of the Product.

 

For all practical purposes, the following legal provisions are recalled:

Art. L217-4 of the Consumer Code: “The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility. »

 

Art. L217-5 of the Consumer Code: "The good complies with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable (a) if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model; (b) if it presents the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling; 2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted. »

 

Art. L217-7 of the Consumer Code: “The defects of conformity which appear within twenty-four months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. For goods sold second-hand, this period is set at six months. The seller can challenge this presumption if it is not compatible with the nature of the goods or the lack of conformity invoked. »

 

Art. L217-8 of the Consumer Code: “The buyer is entitled to demand that the goods conform to the contract. He cannot, however, contest conformity by invoking a defect which he knew or could not ignore when he contracted. The same applies when the defect has its origin in the materials supplied by him. »

 

Art. L217-9 of the Consumer Code: “In the event of a lack of conformity, the buyer chooses between the repair and the replacement of the good. However, the seller may not proceed according to the choice of the buyer if this choice entails a manifestly disproportionate cost with regard to the other method, taking into account the value of the good or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer. »

 

Art. L217-10 of the Consumer Code: “If the repair and replacement of the good is impossible, the buyer can return the good and have the price refunded or keep the good and have part of the price refunded. The same option is open to him: 1° If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month of the buyer's complaint; 2° Or if this solution cannot be without major inconvenience for him given the nature of the property and the use he is looking for. However, the resolution of the sale cannot be pronounced if the lack of conformity is minor. »

 

Art. L217-11 of the Consumer Code: “The application of the provisions of articles L. 217-9 and L. 217-10 takes place at no cost to the buyer. These same provisions do not preclude the award of damages. »

 

Art. L217-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. »

 

Art. L217-13 of the Consumer Code: "The provisions of this section do not deprive the buyer of the right to exercise the action resulting from redhibitory defects as it results from articles 1641 to 1649 of the civil code or any other action of a contractual or extra-contractual nature recognized by law. »

 

Art.1642 of the Civil Code: “The seller is not liable for apparent defects of which the buyer has been able to convince himself. »

 

Art. 1643 of the Civil Code: “He is liable for hidden defects, even if he did not know of them, unless, in this case, he has stipulated that he will not be bound by any guarantee. »

 

Art. 1644 of the Civil Code: “In the case of Articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or keeping the item and getting part of the price refunded. »

 

Art. 1646 of the Civil Code: “If the seller is unaware of the defects of the thing, he will only be required to refund the price, and to reimburse the purchaser for the costs incurred by the sale. »

 

Art. 1648 of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. (…)”

 

 

13 - WARRANTY

All products supplied by the Seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.

Art. 1641 of the Civil Code: "The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which diminish this use so much that the buyer would not have it acquired, or would have given only a lesser price, if he had known them. »

 

In addition, the Customer also benefits from the guarantee of product conformity, provided for by articles L. 211-4 and following of the Consumer Code:

Art. L.211-4 of the Consumer Code: “The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility”.

 

In the event of non-compliance of a product sold, the Customer will have the choice between repairing or replacing the product.

However, if the Customer's choice entails a manifestly disproportionate cost for the Seller, he may proceed according to the method of his choice.

If the repair and replacement of the product are impossible, the Customer may return the product and be reimbursed the price.

Reimbursement of the price is also possible if the solution requested by the Customer cannot be implemented within 1 (one) month following the buyer's complaint.

In any case, the application of the guarantee for non-conformity of the product will take place at no cost to the Customer.

14 - INTELLECTUAL PROPERTY

All the elements of the https://www.lodyssee-paris.com Site, in particular all the graphic, sound, textual and video elements, including the underlying technology and the presentation of the products, are the exclusive property of the Seller, L 'Odyssey Paris.

The Customer is therefore formally prohibited from proceeding with any reproduction, representation or distribution, even partial, of any particular element forming an integral part of the Seller's website.

All reproductions and representations of the Site https://www.lodyssee-paris.com are subject to the express and prior agreement of the Seller.

Failure to comply with this obligation constitutes an infringement engaging the civil and criminal liability of its author.

L'Odyssée Paris is the owner of the brand names, names, denominations, titles of products, drawings, models, photographs mentioned on the site www.lodyssee-paris.com which are either registered trademarks or trademarks, or drawings, models, works subject to intellectual property rights.

Consequently, any reproduction of this mark by the Customer, not authorized by the Seller, constitutes an act of infringement liable to criminal and civil proceedings.

The Customer is therefore prohibited from infringing the "L'Odyssée Paris" brand. It is strictly forbidden to use or reproduce the name of "L'Odyssée Paris", in any capacity whatsoever, and on any medium whatsoever, without the Seller's prior written consent.

 

 

15 - RIGHT OF WITHDRAWAL

Under Community Directive 2011/83/EU of the European Parliament, of the Council of October 25, 2011 on consumer rights in the context of distance sales contracts and Law No. 2014-344 of March 17, 2014; as transposed in the Customer's country, the latter is entitled to cancel his order at any time within 14 (fourteen) calendar days (postmark as proof) following the date on which he received the products .

Beyond this period of 14 (fourteen) days, the sale is firm and definitive.

Once the verification of the returned Items has been carried out, L'Odyssée Paris undertakes to reimburse the Customer for all sums paid, postage included, under his Order, as soon as possible and, at the latest within 30 (thirty) days following the date on which this right was exercised, to the Customer's bank account used for payment of the Items. 

The refund will be made provided that L'Odyssée Paris has received the products initially delivered in perfect condition for resale, in their original packaging, in their original condition, new, labeled, unworn, unwashed.

However, the Customer is informed that the right of withdrawal does not apply to products made according to the Customer's specifications (personalized products).

 

For the validation of your return, the Customer must first complete the form available below in order to obtain a prepaid postal label. Under no circumstances will L'Odyssée Paris refund the return postage paid directly by the Customer to La Poste.

The exercise of the right of withdrawal is materialized by the return of the products and is dated the day of dispatch of the returned products (postmark as proof).

 

To make a return under your right of withdrawal:  

 

As soon as the return is accepted by L'Odyssée Paris, the Customer will be informed by e-mail and may return the package.

To make a return: 

1. The Customer must complete and sign the Withdrawal form.

2. The Customer must insert this Withdrawal slip in his package as well as the Product(s) to be returned.

3. The Customer must enter the following postal address:

Return costs are the responsibility of the Customer.

It is the Customer's responsibility to keep all proof of this return and its date.

Only new, unworn and unsoiled products will be refunded. The Item must be returned in its original packaging accompanied by the label of the garment, its pouch and/or Dust Bag.

 

The return will be refused and will not give rise to reimbursement, in the following cases:

1 - Return of the order without its fabric pouch and/or without Dust bag and/or without sealed or cut label.

2 - The products have been washed, used or worn except for a simple fitting

3 - The product is not complete. If your order includes different products that are not linked together (non-exhaustive examples of products linked together: pair, inseparable set, etc.), you can return only part of your order. Only returned products will be refunded

4 - The products have been modified or denatured

Once the verification of the returned items has been carried out, L'Odyssée Paris undertakes to reimburse the Customer as soon as possible 4 (four) to 5 (five) calendar days, within a maximum period of 30 (thirty) days following the date of validation of the return, to the Customer's bank account or payment account used for payment of the Items.

 

16 - WAIVER AND TOLERANCE

It is formally agreed between the contracting parties that any tolerance or waiver by one of the Parties in the application of all or part of the commitments provided for herein, regardless of the frequency and duration, may not constitute a modification of the present, nor generate any right.

More specifically, no delay or no inaction, abstention or omission on the part of the Seller in the exercise of any of its rights under the terms hereof will prejudice the said rights, nor will it be considered as implying on its part a renunciation to avail themselves of their rights.

 

 

17 - ENTIRETY

These general conditions express the entirety of the obligations of the parties.

No indication, no document, can generate obligations hereunder, if they are not the subject of an amendment signed by both parties.

No correspondence prior to the signing of these presents can give rise to obligations under the said contract.

 

 

18 - PARTIALLY NOT VALID

If a particular stipulation hereof is held to be invalid, or declared as such by a decision having the force of res judicata of a competent jurisdiction, the other stipulations will retain their full force and scope.

 

 

19 - APPLICABLE LAW AND JURISDICTION

These General Conditions of Sale are subject to French law.

In the event that a dispute arises between the parties as a result of the execution or interpretation of these presents, the parties agree prior to any legal action that any claim will be the subject of a prior formal notice by registered mail. with request for acknowledgment of receipt.

Any party may then, after a period of 10 (ten) days following the sending of the letter referred to in the preceding paragraph, initiate any useful procedure before the sole competent courts within the jurisdiction of Paris.

 

 

20 - LIABILITY
